Terms of Service of the Service

I. General Definitions

  • Terms – these Terms of Service.

  • Service – the “Instant Room” online service, available at https://instantroom.pl

  • Service Provider – the owner of the Service, a natural person – Jakub Asztemborski.

  • User – any natural person who gains access to the Service by registering and logging in, and who uses the services provided through the Service by the Service Provider.

  • Electronic Communication – communication between the parties via email.

  • Token – a unit that can be used to generate a room visualization in a given style. The first 5 tokens are free and available upon registration. Additional tokens can be purchased on the Pricing page.

  • Uploaded Material – a photo or graphic uploaded to the Service by the User for the purpose of generating a room visualization.

  • Room Visualization – the final output in the form of a photo or graphic, created on the basis of the User’s uploaded material and the room type and style selected by the User.

II. General Provisions

  • These Terms define the rules for the operation and use of the Service and set out the scope of rights and obligations of Users and the Service Provider related to the use of the Service.

  • The subject of the Service Provider’s services is the generation of room visualizations based on uploaded materials through the tool available in the Service.

  • The Service Provider is not responsible for any subsequent use of the visualizations by Users. The User bears full responsibility for how the materials made available through the Service are used, including using them in compliance with applicable law.

  • Visualizations generated in the Service are intended for both personal and commercial use.

  • The Service Provider reserves the right to remove or deny access to any images that violate these Terms and may block a User’s access to Instant Room if it is found that the User is violating these Terms.

III. Conditions of Use of the Service

  • User registration is free.

  • The first 3 visualizations are free; further generations are paid. Depending on the selected plan and its price, a different pool of tokens is available for creating visualizations.

  • Using 1 token allows you to generate 1 visualization of 1 room in 1 selected style.

  • Use of the Service by each User is voluntary.

  • Users are required to read these Terms and the other documents that form an integral part of them and must accept their provisions in full in order to continue using the Service.

  • Technical requirements for using the Service:

    • a device with a display that enables viewing web pages,

    • an internet connection,

    • a modern web browser that displays websites in accordance with W3C standards and supports HTML5,

    • JavaScript enabled,

    • Cookies enabled.

  • To ensure the security of the Service Provider, Users, and other users of the Service, all Users should follow generally accepted online safety principles.

  • The following actions, carried out personally by Users or via software, are prohibited:

    • decompilation and analysis of source code without prior written consent,

    • actions that cause excessive load on the Service’s server without prior written consent,

    • attempts to detect security vulnerabilities of the Service or server configuration without prior written consent,

    • attempts to upload or inject code, scripts, or software to the server or database that may harm the Service software, other Users, or the Service Provider,

    • attempts to upload or inject code, scripts, or software to the server or database that may track or steal data of Users or the Service Provider,

    • any actions intended to damage, block the operation of the Service, or prevent the Service from achieving its intended purpose.

  • If a cybersecurity incident or a GDPR breach occurs or may potentially occur, Users should first report this to the Service Provider to promptly remove the issue/threat and protect the interests of all Users of the Service.

    • After logging in and paying for a package, the User may generate visualizations based on photos and graphics to which they hold copyrights and which comply with these rules and are not vulgar.

    • Visualizations generated by the User will be available in their account for 60 minutes, after which they will be deleted from the server. Therefore, if the User wishes to keep the images, they should download them to their device as soon as possible.

    • By uploading images to Instant Room, the User retains all rights and ownership in the submitted content. By uploading images, the User represents and warrants that they have the necessary rights and permissions to use and share those images as described in these Terms. The Service Provider reserves the right to verify uploaded materials for compliance with the Terms.

    • The User may not access or use the Service Provider’s services in any automated manner, including but not limited to scraping, the use of browser extensions, or any other methods that may unduly burden our computing or hosting resources.

    • It is also prohibited to use generated images or outputs for training artificial intelligence models or for creating a competing or similar service.

    • The Service Provider shall not be liable for any damages incurred by Users of the Service or third parties in connection with the use of the Service. All risk associated with the use of the Service—particularly the use of created graphics and images—is borne by the User.

    • The User is responsible for all activity performed on their account and may not share their account or password with anyone.

IV. Registration Terms and Rules

  • Users must be registered and hold an account in the Service to use the services provided in the Service that are available only to logged-in Users.

  • Registration in the Service is voluntary.

  • Registration in the Service is free of charge.

  • Each User may hold only one account in the Service.

  • Technical requirements related to account registration:

    • having an individual email account,

    • providing an individual email address during registration,

    • verifying the provided email account by clicking the link sent to it.

  • Users registering in the Service consent to the processing of their personal data by the Service Provider to the extent entered into the Service during the registration process and any subsequent changes or deletion.

  • The Service Provider has the right to suspend or delete Users’ accounts at its sole discretion, thereby preventing or limiting access to some or all services, content, materials, and resources of the Service, in particular if the User violates the Terms, generally applicable laws, principles of social coexistence, or acts to the detriment of the Service Provider or other Users, the legitimate interest of the Service Provider, or third parties cooperating or not with the Service Provider.

  • Any services of the Service may be modified as to their content and scope, added or removed, and may also be temporarily suspended or access to them may be restricted, at the Service Provider’s discretion, without the possibility for Users to object.

  • Additional security rules for account use:

    • Registered Users are prohibited from sharing their login and password with third parties.

    • The Service Provider has no right and will never ask the User for their account password.

  • Account deletion:

    • Each User with an account in the Service may request deletion of the account. To do so, please contact the Service Provider by email at team@instantroom.pl

    • Deleting the account results in the deletion of the User’s room visualizations and the anonymization of the username and email address.

V. Newsletter Service Terms

  • Users may use the Service without subscribing to the Newsletter.

  • Subscribing to the Newsletter is voluntary.

  • Subscribing to the Newsletter is free of charge.

  • Technical requirements related to the Newsletter service:

    • having an individual email account,

  • Conditions for providing the Newsletter service:

    • providing an individual email address in the electronic form,

    • verifying the provided email account by clicking the link sent to it,

    • consenting to receive email notifications.

  • Scope of the Newsletter service:

    • notifications about updates, posts, contests, and other promotional activities related to the Service’s offerings,

    • notifications about promotional activities of the Service’s partners (Marketing messages),

  • Unsubscribing from the Newsletter:

    • Each User subscribed to the Newsletter may unsubscribe at any time.

    • Users can do this via the link included in every email message.

    • Unsubscribing from the Newsletter results in the removal of the provided email address from the Service Provider’s database.

VI. Conditions of Communication and Provision of Other Services in the Service

  • The Service provides services and tools enabling Users to interact with the Service in the form of:

  • The Service provides the following contact data:

    • Email address

  • When a User contacts the Service Provider, the User’s personal data will be processed in accordance with the Privacy Policy, which forms an integral part of these Terms.

  • Conditions for posting content by Users in the Service:

    • It is prohibited to post content that is offensive or defamatory towards the Service Provider, other Users, third persons, or third-party entities,

    • It is prohibited to post textual, graphic, audiovisual materials, scripts, programs, and other works for which the User does not hold a license or for which the owner of economic copyrights has not consented to free publication,

    • It is prohibited to post vulgar, pornographic, erotic, or otherwise illegal content or links to pages containing such content,

    • It is prohibited to post scripts and programs that excessively burden the server, illegal software, software used to breach security, or similar, as well as links to pages containing such materials,

    • It is prohibited to post marketing content and advertisements for other commercial services, products, or commercial websites.

VII. Limitation of Liability

In no event shall the Instant Room service and its staff be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Service; any conduct or content of third parties on the Service; any content obtained from the Service; and unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not the Service Provider has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.


VIII. Collection of Users’ Data

The Controller may also process contact data of company representatives obtained from publicly available sources (e.g., company websites or industry portals) for the purpose of establishing business contact and presenting information about services offered within the Service, pursuant to Article 6(1)(f) of the GDPR (legitimate interest of the Controller).

To properly provide services through the Service, to secure the legal interests of the Service Provider, and to ensure compliance of the Service with applicable law, the Service Provider collects and processes certain data about Users via the Service.

To properly provide services, the Service uses and stores certain anonymous information about the User in cookies.

The scope, purposes, methods, and rules of data processing are available in the appendices to the Terms: GDPR Information Duty and in the Privacy Policy, which form an integral part of these Terms.

The Service Provider may also process contact data of company representatives obtained from publicly available sources (e.g., company websites, industry portals, or professional directories) solely for the purpose of establishing business contact and presenting information about services available within the Service. The legal basis for such processing is the Service Provider’s legitimate interest, pursuant to Article 6(1)(f) of the GDPR.

  • Data collected automatically:
    For the efficient operation of the Service and for statistics, we automatically collect certain data about the User. This data includes:

    • IP address

    • Browser type

    • Screen resolution

    • Approximate location

    • Opened subpages of the Service

    • Time spent on a given subpage of the Service

    • Type of operating system

    • Address of the previous subpage

    • Referring page address

    • Browser language

    • Internet connection speed

    • Internet service provider

    • Anonymous demographic data based on Google Analytics data:

      • Gender

      • Age

      • Interests

    • Anonymous data necessary for serving ads:

      • Remarketing data

      • Data related to ad display reporting

  • The above data is obtained via the Google Analytics script and is anonymous.

  • Data collected for marketing purposes used in Google Ads, Meta Ads, Pinterest Ads, TikTok Ads:

    • package purchase, transaction ID, purchase value

    • remarketing data

    • data related to enhanced conversions (email)

  • Data collected during registration:
    Username, email address. For logged-in Users (those who hold an account in the Service), the cookies stored on the User’s device may contain a User identifier associated with the User’s account.

  • Data collected when subscribing to the newsletter:
    email address

IX. Acceptable Use

  • Visualizations generated in the Service are intended for both personal and commercial use.

  • The User agrees to use Instant Room solely to generate images that are appropriate and lawful. You may not use our services to create, promote, or distribute any images that:

  • contain explicitly sexual or pornographic content;

  • promote violence or hatred against individuals or groups on the basis of race, ethnicity, religion, gender, disability, or any other protected characteristic;

  • violate any applicable laws or regulations, including without limitation copyrights, trademarks, or intellectual property rights; or

  • are otherwise deemed inappropriate by the Service at its sole discretion.

X. Copyright

  • The owner of the Service and the copyrights in the Service is the Service Provider.

  • To the extent permitted by applicable law, we grant you the right to personal and commercial use of visualizations generated by Instant Room. However, we make no representations or warranties regarding the uniqueness of the generated images.

  • Under the Polish Copyright Act of 4 February 1994, it is prohibited to use, copy, reproduce in any form, and store in search systems—except for the search engines Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn—any articles, descriptions, photos, and any other content, graphic materials, video or audio found in the Service without the written consent or consent provided via Electronic Communication by their lawful owner. This exclusion does not apply to visualizations generated by the User.

  • According to the Polish Copyright Act of 4 February 1994, simple press information—understood as mere information without commentary and opinion of the author—is not protected. The author understands this as permission to use information from texts posted on the Service, but not to copy all or part of articles unless this is indicated in a given material made available in the Service.

XI. Changes to the Terms

  • All provisions of the Terms may be changed unilaterally by the Service Provider at any time without stating reasons.

  • Information about changes to the Terms will be sent by Electronic Communication to Users registered in the Service.

  • In the event of changes to the Terms, their provisions take effect immediately upon publication for Users.

  • It is deemed that any User who continues to use the Service after the Terms have changed accepts them in full.

XII. Final Provisions

  • To the fullest extent permitted by applicable law, the Service Provider is not responsible for content transmitted and published in the Service by Users, including its truthfulness, reliability, authenticity, or legal defects.

  • The Service Provider will make every effort to offer the Service continuously. However, the Service Provider bears no responsibility for disruptions caused by force majeure, unauthorized interference by Users or third parties, or the operation of external automatic programs.

  • Although the Service Provider attempts to maintain the security and integrity of data and images generated via the Service, the Service Provider cannot be held liable for any loss of data or images that may occur. If a User deletes their account, the Service reserves the right to delete any data or images associated with the user’s account. Users are advised to regularly back up generated images to ensure their retention.

  • The default Instant Room policy is not to issue refunds due to the costs associated with generating images using artificial intelligence. However, the Service Provider may consider refund requests on a case-by-case basis at its sole discretion. A decision regarding any partial or full refund will be taken by the Service Provider.

  • The Service Provider provides no warranty as to the fitness for purpose of materials placed in the Service. Room visualizations are generated using an AI tool. The Service Provider does not warrant that the Room Visualization Service will operate uninterrupted, timely, securely, or error-free. The Service makes no warranties or representations regarding the accuracy, timeliness, or completeness of any materials provided through the Service. Use of the Service is at your own risk.

  • The Service Provider reserves the right to change any information posted on the Service at a time of the Service Provider’s choosing, without prior notice to Users.

  • The Service Provider reserves the right to temporarily, fully, or partially disable the Service for improvement, adding services, or maintenance, without prior notice to Users.

  • The Service Provider reserves the right to permanently disable the Service without prior notice to Users.

  • The User agrees to indemnify, defend, and hold harmless the Instant Room Service and its staff from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of Instant Room, including, without limitation, claims related to the infringement of copyrights or intellectual property rights.

  • The Service Provider reserves the right to assign, in whole or in part, any of its rights and obligations related to the Service, without the consent of Users and without any possibility for Users to object.
